DMCA Policy for Name Bangla

Name Bangla (https://namebangla.com/) respects the intellectual property rights of others. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted a policy of responding to notices of alleged copyright infringement. This policy describes the information that should be present in a DMCA notice, and the process for submitting one, as well as the actions we may take in response.

Notification of Copyright Infringement

If you believe that any content posted on Name Bangla infringes on your copyright, please send a written notification to our Designated Copyright Agent with all of the information outlined below. This procedure is exclusively for notifying Name Bangla that your copyrighted material has been infringed.

Upon receipt of a valid and complete DMCA notice, Name Bangla will take appropriate action, which may include removing or disabling access to the allegedly infringing material.

Elements of a Valid DMCA Notification

For your DMCA notice to be valid and effective, it must include substantially the following:

  1. A Physical or Electronic Signature: The physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. This can be a scanned signature, a typed name in an email from the authorized party, or another verifiable electronic signature.
  2. Identification of the Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site. Please provide specific details, such as the title of the work, and where possible, registration numbers.
  3. Identification of the Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Name Bangla to locate the material. This requires providing the specific URL(s) where the infringing material is located on our website. General descriptions are not sufficient.
  4. Contact Information of the Complaining Party: Information reasonably sufficient to permit Name Bangla to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. A Statement of Good Faith Belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A Statement of Accuracy and Authority: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please allow for a reasonable time for a response. Note that sending your complaint to other email addresses or contacts will not be considered a valid DMCA notification.

Counter-Notification Procedure

If you believe that the material you posted on Name Bangla was removed or disabled by mistake or misidentification, you have the right to file a counter-notification with our Designated Copyright Agent. To be effective, a counter-notification must be a written communication that includes substantially the following:

  1. Your Physical or Electronic Signature: A physical or electronic signature of the subscriber.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled. Please provide the specific URL(s).
  3. A Statement Under Penalty of Perjury: A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your Contact Information and Consent to Jurisdiction: Your name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber’s address is outside of the United States, for any judicial district in which Name Bangla may be found, and that the subscriber will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, Name Bangla will promptly provide the complaining party with a copy of the counter-notification. The complaining party then has 10 business days to inform Name Bangla that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system. If Name Bangla does not receive such notification within 10 business days, we may replace the removed material or restore access to it.

Repeat Infringers Policy

Name Bangla reserves the right to terminate access to the Site for users who are repeat copyright infringers. We may, in appropriate circumstances, and at our sole discretion, terminate the accounts of users who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

Important Considerations

  • Misrepresentations: Any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, shall be liable for any damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorized licensee, or by a service provider, who is injured by such misrepresentation, as provided in the DMCA.
